The opinion of the court was delivered by This is an action by an insured, the plaintiff herein, to recover monthly accident benefits under an accident and sickness income policy written by the defendant insurance company. The case was tried to a jury which returned a verdict in favor of the plaintiff and the defendant has appealed. The case is now making its second appearance before this court. Our decision in the former appeal is reported in Williams v. Benefit Trust Life Ins. Co., 195 Kan. 579, 408 P.2d 631, to which reference will be made as occasion demands.
